terms

These terms cover using this website and joining Find Your Own Sound. They are written to be read, so they are plain rather than dense. Please read them before you join.

1. Who we are

Find Your Own Sound ("FYOS", "we", "us", "our") is operated by Ceri Owens, a sole trader based in the United Kingdom. Address for service of documents: Unit 7, Hollybush Place, London E2 9QX.

You can reach us any time at [email protected].

2. What these terms apply to

By using findyourownsound.com, applying for an invitation, or joining FYOS, you agree to these terms. If you do not agree with them, please do not use the site or join.

We may update these terms. If we change anything that materially affects you as a member, we will tell you by email before it takes effect.

3. Who can join

FYOS is for people aged 18 and over. Membership is invite-only. Applying does not guarantee a place, and we may decline an application without giving a reason.

Your membership is personal to you. You may not share, transfer or resell your access, and you may not share your login with anyone else.

4. What membership includes

Membership gives you access, for the period you have paid for, to the things described on the site at the time you join. That currently includes the Find Your Own Sound Masterclass, personalised feedback on your tracks, live mentoring and Q&A calls, the private member community, and live sessions with industry guests.

We run FYOS as a living programme, so specific sessions, guests and materials change over time. We may add, replace or retire individual elements, and we will not materially reduce what you have paid for during your membership period.

Live calls are scheduled in advance. If you cannot attend one, sessions are recorded and stay available to you inside the community, unless a guest asks us not to record theirs.

5. Prices and payment

The price is the one shown to you at the time you join. Payments are taken through Stripe. We never see or store your full card details.

Where a payment plan is offered, you are agreeing to the full amount, collected in the instalments shown. If a payment fails we will try again and let you know. If it stays unpaid we may suspend access until it is settled.

Unless we say otherwise in writing, prices include VAT where it applies.

6. Your right to change your mind

If you are a consumer in the UK or EU, you normally have 14 days from joining to cancel and get a refund, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Because FYOS gives you immediate access to digital content and to a live service, when you join you are asking us to start straight away, and you accept that you lose the right to cancel once the digital content has been made available to you. If you would rather keep your cancellation right, do not access the material and email us within the window.

Outside that, memberships are non-refundable, because places are limited and holding one keeps someone else out. If something has genuinely gone wrong, email us and we will talk to you like a person.

7. Renewing and continuing

Memberships do not renew automatically. Near the end of your membership period we will contact you about continuing, and any continuation is a new purchase you choose to make.

When your membership period ends, access to the community and to live calls ends with it.

8. Your music and your content

Your music stays yours. Sending us a track for feedback does not give us any ownership of it.

You do give us permission to listen to it, work on it, and discuss it with you, including on a live call where other members may be present. If you would rather your track was only reviewed privately, tell us when you send it.

We may quote anonymised examples of common issues when teaching. We will not publish your track, your name or your artist identity in marketing without asking you first.

9. Our material

The Masterclass, recordings, templates, written material and anything else we provide belong to us or to our contributors. You get a personal, non-transferable licence to use them while you are a member and for your own music.

You may not record, download where downloads are not offered, republish, share, resell or use our material to build a competing programme.

10. Behaviour inside the community

FYOS works because people are honest with each other about unfinished music. That needs a room where nobody is afraid to post.

  • Be decent to other members. No harassment, abuse or discrimination.
  • No spam, and no promoting your own services to members outside the spaces set aside for it.
  • Do not share other members' music, messages or personal details outside the community.

We can remove access without a refund for serious or repeated breaches. We would always rather have a conversation first.

11. Results

We do not guarantee any particular result. FYOS is education, feedback and support. We cannot and do not promise that you will get signed, release on a particular label, reach any number of streams, or earn any amount of money.

Any results, case studies or testimonials on this site are what those specific people achieved. They are examples, not averages, and they are not a promise of what you will achieve. What you get out of FYOS depends mostly on the work you put in.

12. Not professional advice

Nothing in FYOS is legal, financial, tax or accounting advice. Conversations about deals, contracts, royalties or running your music as a business are general guidance from experience. Take your own professional advice before signing anything.

13. The website

We try to keep the site up and accurate, but we do not promise it will always be available or error free. We may change or remove parts of it.

The site may link to other places. We are not responsible for what is on them.

14. Our responsibility to you

We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. Nothing here affects your statutory rights as a consumer.

Otherwise, our total liability to you is limited to the amount you have paid us in the twelve months before the claim, and we are not liable for lost profits, lost opportunities or lost data.

15. Ending things

You can leave at any time by emailing us. Leaving part way through a paid period does not create a refund, except where section 6 applies or the law says otherwise.

We may end your membership if you breach these terms, if payment fails and stays unpaid, or if your behaviour makes the community worse for everyone else.

16. Law and disputes

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live elsewhere in the UK or in the EU, you keep the protection of the mandatory consumer law of the country you live in.

17. Complaints

Email [email protected] and we will reply. If you are a consumer and we cannot resolve it between us, you may be able to use an alternative dispute resolution service.

18. Independence from the platforms we advertise on

FYOS is not affiliated with, endorsed by, sponsored by or administered by Meta Platforms, Instagram, Facebook, Google, YouTube, TikTok or any other advertising or social platform. Where we advertise on those platforms, we are a customer of theirs, nothing more.

privacy

This explains what we collect, why, who we share it with, and what you can tell us to do about it. We run paid advertising and we measure it, so this page is specific about that rather than vague.

1. Who controls your data

Ceri Owens, trading as Find Your Own Sound, is the data controller for the personal data described here. Sole trader based in the United Kingdom, address for service of documents Unit 7, Hollybush Place, London E2 9QX.

For anything about your data, email [email protected].

2. What we collect

Information you give us

  • Your name, email address, and phone number where you give it
  • Your Instagram handle and the content of direct messages you send us, because applications start in a DM
  • What you tell us in an application or enquiry: your experience, your goals, the software you use
  • Billing details, handled by Stripe. We receive a record of the payment and the last four digits of the card. We never receive or store the full card number.
  • Music, audio files and project files you send us for feedback
  • Messages and posts you make inside the member community

Information we collect automatically

  • IP address, approximate location from it, device type, operating system, browser and language
  • Pages you visit, how you arrived, how long you stay and what you click
  • Advertising click identifiers appended to links, such as Meta's fbclid, Google's gclid and TikTok's ttclid, plus campaign tags in the URL such as utm_source and utm_campaign
  • Anonymised session recordings and heatmaps showing how pages are used, where we have your consent
  • Whether you opened an email from us and which links you clicked

Information from other people

  • Meta, Google and other advertising platforms tell us, in aggregate, which campaigns produced enquiries
  • Stripe tells us whether a payment succeeded and flags suspected fraud
  • If someone refers you, we may learn your name from them

3. Why we use it, and our lawful basis

What we doWhyLawful basis
Review applications and reply to enquiriesTo decide whether to offer a place and to answer youSteps before a contract, and legitimate interests
Deliver the programmeCalls, feedback, community access, materialsPerformance of a contract
Take payment and keep financial recordsTo get paid and to satisfy HMRCContract, and legal obligation
Support and service messagesTo tell you a call is starting, a payment failed, or access is endingContract
Marketing emails and messagesTo tell you about FYOS and when places openConsent, or the soft opt-in for existing customers
Advertising, retargeting and audience buildingTo reach producers like you, and to stop showing ads to people who already joinedConsent, given through the cookie banner
Measuring which ads workSo we do not spend money on ads nobody responds toConsent for cookies and similar, legitimate interests for aggregate reporting
Analytics, heatmaps and session recordingsTo find the parts of the site that confuse peopleConsent
Security and fraud preventionTo protect the site, the community and the paymentsLegitimate interests
Handling a legal claim or complaintTo defend or resolve itLegitimate interests, and legal obligation

Where we rely on legitimate interests, we have considered your rights and concluded that our interest does not override them. You can ask us to explain that reasoning, and you can object.

4. Advertising and measurement, in plain terms

We advertise FYOS on Meta, and we may advertise on Google, YouTube, TikTok and similar platforms. To do that without wasting money, we measure what happens after someone clicks.

  • The Meta pixel and Conversions API. A small piece of code on the site tells Meta when a page is viewed or an action is taken. The Conversions API sends the same kind of event from our server instead of your browser. We may include a version of your email address that has been turned into an irreversible string of characters, so Meta can match it to an account without us handing over the address itself.
  • Google Analytics 4 for aggregate traffic and behaviour, and Google Ads tags where we run Google campaigns.
  • Microsoft Clarity for heatmaps and anonymised session recordings. Recordings are used to see where people get stuck. Typing in form fields is masked.
  • Custom and lookalike audiences. We may give an advertising platform a list of contacts, again as irreversible hashed values, so it can show ads to those people, exclude them, or find new people with similar patterns.
  • Click identifiers and campaign tags in links, so we know which ad or post brought you here.

These run only where you have accepted advertising and analytics cookies. You can change your mind at any time, see the cookies section below.

5. Who we share it with

We do not sell your personal data. We share it with the companies that make FYOS work:

WhoWhat for
StripeTaking payments and preventing fraud
HighLevel (GoHighLevel)Our CRM, website hosting, email and SMS
MemberUpThe private member community
GoHighLevel, Loom, VimeoHosting and delivering live calls, recordings and the Masterclass
Meta PlatformsAdvertising and measurement
GoogleAnalytics and advertising
Microsoft (Clarity)Heatmaps and session recordings
Our accountantsBookkeeping and tax
Professional advisers, or authoritiesWhere the law requires it, or to establish or defend a legal claim

6. Sending data outside the UK

Several of those companies are based in the United States or store data there. Where data leaves the UK we rely on UK adequacy regulations, the UK International Data Transfer Agreement, or the UK Addendum to the EU Standard Contractual Clauses, together with additional safeguards where they are needed. You can ask us for details of the safeguards used for a particular transfer.

7. How long we keep it

  • Enquiries and applications that do not become memberships: 24 months
  • Member records, including music you sent for feedback: 3 years after your access ends, so we can help if you come back
  • Payment and accounting records: 6 years after the end of the financial year, because UK tax law requires it
  • Marketing contacts: 24 months after you last engaged with us, unless you unsubscribe sooner
  • Analytics and advertising data: as set by the platform, typically between 2 and 26 months

Community posts stay in the community unless you ask us to remove them.

8. Your rights

Under the UK GDPR you can ask us to:

  • Give you a copy of the personal data we hold about you
  • Correct anything that is wrong
  • Delete it, where we do not have a reason to keep it
  • Restrict what we do with it while something is being sorted out
  • Send it to you, or to someone else, in a portable format
  • Stop using it, where we rely on legitimate interests
  • Stop using it for direct marketing, which is an absolute right and takes effect immediately
  • Withdraw consent you have given, at any time, without affecting what was done before

Email [email protected] and we will respond within one month. There is no charge.

If you are not happy with how we have handled it, you can complain to the Information Commissioner's Office at ico.org.uk or on 0303 123 1113. We would appreciate the chance to put it right first.

9. Automated decisions

We do not make decisions about you by automated means alone. A person reads every application.

10. Children

FYOS is not for under 18s and we do not knowingly collect data about children. If you believe we have, tell us and we will delete it.

11. Security

We use reputable providers, access controls and encryption in transit. No system is perfectly secure, but if a breach affects your rights we will tell you and the ICO as the law requires.

12. Changes

If we change this notice we will update the date at the top, and we will tell members by email if the change is significant.

cookies

Cookies are small files a site stores on your device. We also use similar technologies such as pixels, tags, local storage and server-side events, and where this page says cookies it means all of them.

Your choice

Cookies that are strictly necessary are always on, because the site does not work without them. Everything else, analytics and advertising included, is set only after you accept it. You can change your mind at any time by clearing cookies for this site and choosing again, or by emailing us.

Turning them off

  • In your browser. Every modern browser lets you block or delete cookies. Blocking the strictly necessary ones will break parts of the site.
  • On Meta. Your ad preferences are in Settings, then Accounts Centre, then Ad preferences, on Facebook or Instagram.
  • On Google. Ad settings at myadcenter.google.com, and a Google Analytics opt-out add-on at tools.google.com/dlpage/gaoptout.
  • Across many advertisers at once. youronlinechoices.com/uk.

Turning off advertising cookies does not mean you stop seeing ads. It means the ones you see are less relevant, and we can no longer tell whether ours worked.

Global Privacy Control

Where your browser sends a recognised Global Privacy Control or Do Not Track signal, we treat it as a request not to set analytics or advertising cookies.
